Jurors deadlocked after deliberating for approximately 38 hours over seven days. Jury notes indicated they were split 11 to 1, but any verdict must be unanimous. “I think if it’s 11 to 1, the district attorney and the defense attorney will get together and come to some kind of agreement so she doesn’t retire,” Aronberg said. “It’s going to be a mental hospital… (or) some kind of deal. Because who wants to go through all of this again, especially when you’re so close to getting an acquittal? Why would you, as a prosecutor, want to do it all over again and take another beating,” he said. Plymouth County District Attorney Timothy Cruz said prosecutors will decide whether to retry the case at a future hearing. Aronberg said: “Now that you’ve seen it 11 to 1, it is a prosecutor’s ethical duty to bring charges only when he believes in good faith that he can obtain a conviction beyond a reasonable doubt, and if he does not believe he can obtain a conviction beyond a reasonable doubt… then he should not pursue the case.” “In the end, you have to look reality in the face, and if you can’t get anything more than 11 to 1 against you, I think it’s time to take a plea deal,” he added.
